The Wollongong City Council has engaged with the property owner and business operator regarding the absence of proper development consent before the café’s establishment. Despite being informed that operating as a café was unauthorized, the business commenced operations.
Subsequently, in early 2024, council officers issued a development control order to cease the unpermitted activities. Following this, discussions were held between council officials, the business operator, and the landlord to explore avenues for regularization. The business then submitted a development application seeking approval as a food and drink establishment, leading to a temporary halt on the development control order during the application review.
After the assessment, the development application was declined. A meeting was held on October 3rd with the business operator and landlord to reinstate the development control order, offering an extended compliance deadline to allow the business to operate during the summer months. Despite community interest and investment, the council emphasizes the importance of adherence to planning regulations and operational standards.
The council’s role extends to ensuring businesses comply with fire safety regulations, adhere to food premises fit-out standards, provide disability access, maintain neighborhood amenity, and consider parking availability.
